1. About encore-haus
encore-haus is an Australian community platform that enables women to swap, sell and discover pre-loved fashion. By creating an account and using encore-haus, you agree to these Terms & Conditions.
encore-haus is a platform only. We do not own, buy, sell or control any items listed. All exchanges are arranged directly between members. We are not a party to any transaction between members.
2. Eligibility
To use encore-haus you must:
- Be 18 years of age or older
- Be located in Australia
- Complete our identity verification process (via Stripe Identity)
- Agree to these Terms & Conditions and our Privacy Policy
encore-haus reserves the right to refuse or terminate membership at our discretion.
3. Membership and fees
encore-haus offers the following membership tiers:
- Free membership: browse listings, list items, receive swap requests. One free swap on signup.
- Encore Member ($9.99/month or $79/year): unlimited swap and purchase arrangements
- Encore Plus ($19.99/month or $159/year): all Encore Member benefits plus priority placement in the browse feed
Membership fees are charged in Australian dollars. Subscriptions renew automatically unless cancelled. You may cancel your subscription at any time through your account settings. No refunds are provided for partial billing periods.
4. Listing items
When listing an item on encore-haus you confirm that:
- You are the legal owner of the item
- The item is accurately described and photographed
- The item is in near-new condition — worn 1–3 times
- The item is not counterfeit, stolen or prohibited
- You have the right to sell or exchange the item
encore-haus reviews all listings before they go live. We reserve the right to reject any listing that does not meet our quality standards, without explanation.
5. Swaps and exchanges
encore-haus facilitates connections between members but is not responsible for the outcome of any swap or sale. Members are solely responsible for:
- Arranging the logistics of any exchange
- Meeting in a safe, public location
- Inspecting items before completing an exchange
- Resolving any disputes directly with the other member
We strongly recommend meeting at an official encore-haus Swap Spot or another well-lit, public location. We do not recommend exchanging items at private residences.
encore-haus does not process payments between members. All financial arrangements for sell/buy transactions are made directly between members.
6. Prohibited conduct
You must not use encore-haus to:
- List counterfeit, stolen or prohibited items
- Misrepresent the condition, brand or authenticity of any item
- Harass, threaten or abuse other members
- Engage in fraudulent activity of any kind
- Create multiple accounts or circumvent a suspension
- Use the platform for any commercial or business purposes
- Scrape, copy or reproduce platform content without permission
Violations may result in immediate account suspension or termination.
7. Identity verification
All members must complete identity verification via Stripe Identity before transacting on the platform. This process involves submitting a government-issued ID and a selfie. By completing verification you consent to Stripe Identity processing your biometric data in accordance with Stripe's terms and privacy policy.
8. Ratings and reviews
After completing a swap or sale, members are invited to rate each other. Ratings must be honest and based on your genuine experience. encore-haus reserves the right to remove ratings that are fraudulent, abusive or in violation of these terms.
9. Swap Spots
Swap Spots are partner venues that encore-haus has arranged as recommended meeting locations. encore-haus is not affiliated with, responsible for or liable for the conduct of Swap Spot venues or their staff. Member discounts at Swap Spots are subject to availability and the individual venue's terms.
10. Limitation of liability
To the maximum extent permitted by Australian law, encore-haus is not liable for:
- Any loss or damage arising from exchanges between members
- The accuracy of item descriptions or photos provided by members
- Any personal injury or property damage arising from a meetup
- Any indirect, incidental or consequential loss
Nothing in these terms limits any rights you may have under the Australian Consumer Law.
11. Intellectual property
encore-haus and its content (excluding member listings) are owned by encore-haus. You may not reproduce, distribute or create derivative works from our content without written permission. By listing items on encore-haus, you grant us a non-exclusive licence to display your listing photos on the platform.
12. Account termination
You may delete your account at any time through the app settings. encore-haus may suspend or terminate your account if you breach these terms. Upon termination, your listings will be removed and any active swap requests will be cancelled.
13. Changes to these terms
We may update these Terms & Conditions from time to time. We will notify you of significant changes via email or in-app notification. Continued use of encore-haus after changes are posted constitutes your acceptance of the updated terms.
14. Governing law
These Terms & Conditions are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
